 If you are involved in an accident:

• Do not make any admission of liability
• Contact Oceanic Insurance Brokers as soon as possible
• Obtain Associated Marine Insurers written consent before incurring or agreeing to pay any legal costs or monies to third parties
• Make a report to the Bareboat Operator 

Only Associated Marine Insurers have the right to settle or defend a claim against you by another party.

Sum insured $5,000,000 in the aggregate including legal costs (this means a total of $5,000,000 any one accident).

Your Policy

This policy is designed to protect you from claims made against you by others for property loss, accidental death, bodily injury or illness to them caused by (or as a result of ) your negligence. For this policy to apply to you, the hire vessel or its tender must be involved in the loss.

Associated Marine Insurers agree to indemnify the hirer/s, whose name/s are listed in the certificate, for any sums which he/she/they shall become legally liable to pay and shall pay, resulting from his/her/their negligence in the operation or use of the hired vessel named in the certificate and arising out of any accidents occurring during the currency of this insurance in respect of:

1. Loss of or damage to any other vessel or property whatsoever.
2. Accidental death, bodily injury or illness to any person not listed on the certificate herein.
3. Any attempted or actual raising, removing or destroying of the wreck of any other vessel.
4. Any failure to raise and remove the said wreck of any other vessel.
5. Pollution arising from a sudden and accidental discharge of the hired vessel’s own fuel and/or lubricants but limited to $250,000 any one accident.

In conjunction with Clauses 1 to 5 and with their consent, Associated Marine Insurers will also pay:

6. The legal costs incurred by the Hirer(s).
7. The costs for the representation at any coroners inquest or fatal accident inquiry.

 This insurance does not cover any liability cost or expense arising from or as a result of:

1. Death, bodily injury or illness of the hirers.
2. Damage to any property belonging to the hirers.
3. Any direct or indirect payment by the Hirer(s) under Workmens Compensation or Employers Liability acts and any other statutory or common law liability in respect of accidents to or illness of workmen or other persons employed in any capacity whatsoever by the Hirer(s).
4. Any person engaged in parasailing, water skiing, diving or land based activities not associated with the direct use of the vessel or its tender.
5. Fines, penalties, punitive or exemplary damages however described.
6. Breaches of Statutory Laws, By Laws or Regulations.
7. Damage to the hired vessel caused by the Hirer/s.
8. Pollution risks other than as provided for herein.
9. War or warlike activity and acts of terrorism (war does not have to be declared).
10. Hostilities, rebellion, insurrection or revolution.
11. Anything nuclear or radioactive. 

This insurance is subject to Australian Law and Jurisdiction
